• Mark Ressa, Esq. Scheduled to Teach at the State Bar Section Education Institute (SEI) in Berkley

Mark Ressa, Esq. will teach for the State Bar at next year's Section Education Institute (SEI) being held at the Claremont Resort & Spa in Berkley on Sunday, January 18, 2009.

The course is entitled "Imputing Income for Purposes of Child and Spousal Support." Mr. Ressa will present with San Francisco family law attorney Stephen Ruben, Esq. of The Ruben Law Firm, and East Bay vocational evaluation expert, Marlis Bruns, M.S.

• Mark Ressa, Esq. and Jason J. Elter, Esq. Move to New Offices in Bishop Ranch; Expanded Service Offerings

Mark Ressa, Esq. and Jason J. Elter, Esq. will move their current office located in San Ramon, to a larger, more upscale office within the Bishop Ranch Business Complex in San Ramon on about December 15, 2008.

"With the new office, which is double the space of our current office, we will be able to provide more relevant family law services. Although we have always provided mediation, collaborative law services, and 'unbundled legal services,' we will also provide 'enhanced paralegal services. Providing clients with cost effective alternatives to litigation is especially important given today's economy. Law firms need to be responsive to the needs of their client base. With this move, we can do that," said Mr. Ressa.

Those expanded services will focus on lower cost mediation, 'unbundling of legal services,' and providing enhanced paralegal services in addition to providing traditional litigation-based services.

"The vast majority of paralegal services are self-help; no different than filling out forms on the Internet. They cannot or do not provide supervision by licensed attorneys nor is it easy for clients to change from self-representation to attorney representation back to self-representation without a cost impact for each transition," explains Mr. Ressa. “Again we are trying to be sensitive to our worsening economic circumstances by providing clients with hybrid service offerings."

Lastly, both Mark Ressa, Esq. and Jason J. Elter will now emphasize the 'unbundling of legal services'

"In a traditional attorney-client representation model, the attorney is the conduit through which all activity and communication flows. That is usually the best model. But in today’s economy clients cannot afford to pay for endless communication strings between attorneys or discovery requests. Often one side leverages the prohibitive cost of litigation against the lower earner’s ability to fight for what they are rightfully entitled to under the law. In those situations, justice is not being served by the traditional attorney-client representation models."

"By unbundling our legal services, a client can hire us to only appear in court, only to negotiate a settlement, only to sit in on a deposition, only to be their consulting attorney" says Mr. Ressa.

• Mark Ressa, Esq. Appointed to the State Bar's Family Law Executive Committee (FLEXCOM) for 2008-2011

Mark Ressa, Esq. has been appointed to a three (2008-2011) term to the Family Law Executive Committee of the California State Bar. He was the only such Bay Area family law attorney so appointed in 2008.

He was also appointed the Editor of the Family Law Section's eNews (2008-2009) and Vice-Chair for the Family Law Section's Online Continuing Education (2008-2009).

Prior to his appointment to FLEXCOM, he served as Chair (2006-2008) and Vice-Chair (2005-2006) of the State Bar Family Law Section's Bay Area Regional Standing Committee, formerly known as Financial Issues North. He is a member of the state and local bar associations.

Impact on the Economy

The downturn of the housing market, financial markets collapsing and unemployment at a 15 year high, how do these economic conditions affect and impact your divorce?

The answers to this very important question are still emerging. Law tends to lag in providing solutions to fast moving events. Judges are struggling to make fair decisions but are sometimes stuck having to implement rules that have little relevancy in today’s economy.

Approach

Mr. Ressa's approach to family law is pragmatic and designed to produce results. "From the first interview, we identify what matters most to the client. For example, a client might think it important to remain in the family residence. It might be to have a greater share of time with the children. It might be to terminate a spousal support order others say will go on forever. Armed with this knowledge, we define and integrate the client's long term objectives into a legal strategy that is consistent with the law and best minimizes the emotional and financial impact of divorce."

Next, Mr. Ressa focuses on getting the client through the divorce with all deliberative speed. "Once we have identified what matters most to the client and devised a strategy to accomplish those goals in the most direct and efficient fashion, we try to get the client through the divorce process as quickly as possible consistent with doing a great job. Although the court system allows a great deal of latitude how quickly parties are allowed to finalize their divorce, beyond the 6 month minimum timeframe, the most frequent complaint heard by clients after paying too much for their divorce, is how long it took. This rarely benefits the client."

An area in which attorneys do their clients a disservice is in not exploring alternatives to litigation. This is especially true when those alternatives may require an attorney to refer the client elsewhere. "There is more than one way to divorce a spouse. Regrettably, attorneys rarely explore alternatives outside their own field of expertise."

Unfortunately that leaves the client to make what might be the most important decision of their divorce without professional guidance. "A couple seeking a divorce might be better off mediating their divorce, resolving it through collaborative non-adversarial strategies or by purchasing only the services they need. But if a client goes to an attorney who has no appreciation of the pros and cons of these alternatives, or if an attorney is simply interested in selling what they have to sell, the client loses out and ends up with litigation which may not be the solution that works best for them."

In that regard, Mr. Ressa makes an analogy to the practice of medicine. "Imagine a patient going to a doctor and not being told about alternative treatments for a particular disease or condition. Imagine undergoing surgery because that is what the doctor knows best even though surgery might not be the best treatment for that patient's condition. By the same token, a person contemplating a divorce, a very important life decision indeed, is entitled to be informed about the full range of options available."

It is important to note that Mr. Ressa's law practice is separate and distinct from Mr. Elter's so those contemplating retaining Mr. Elter should discuss with him his approach.
